5. DISCLAIMER OF WARRANTIES, EXPRESS OR IMPLIED. LLD believes that individuals who are drivers with a driver`s license and/or who are authorized to drive in accordance with all applicable laws that learn, practice and incorporate the concepts of teensmart hardware reduce their risk of being involved in car accidents. However, all drivers drive vehicles at their own risk. LLD does not warrant, expressly or implicitly, and expressly disclaims any warranty given by AKN that the Software and/or teenSMART Hardware will prevent individuals, including, but not limited to, adolescents using the Software and/or teenSMART Materials, from being involved in car accidents. The teenSMART software and hardware also does not replace driver training courses, courses or similar training. Except as expressly stated otherwise herein, the teenSMART Software and Hardware are provided and you agree to the teenSMART Software and Hardware „AS IS“ and all risks associated with AKN with respect to the results, impact, quality and performance of the teenSMART Software and/or Hardware are assumed and accepted solely by you. You must pay all fees associated with using a credit card (or other payment method accepted by PaperCut); 13. INDEMNIFICATION. Upon request, you will fully reimburse the LLD Parties for any payment made by or on behalf of any of the LLD Parties at any time with respect to the liabilities to which the foregoing indemnification relates. LLD undertakes to notify you in writing of such claims for the liabilities to which the foregoing indemnification relates, and you must promptly assume the defense at your own expense and expense and provide the LLD Parties with competent and experienced attorneys who are acceptable to the LLD Parties in their sole discretion to defend such liability claim.
You may participate in the defense of the same at your own expense by a lawyer of your choice: provided that the final control and disposition (by regulation, compromise or otherwise) remain in the hands of the LLD parties. If the parties to the LLD otherwise settle or compromise such a claim for liabilities, the costs (including all attorneys` fees and related costs) will be your sole responsibility if such settlement or compromise has been made with your prior consent so as not to be unreasonably withheld, delayed or conditioned. In a switch stack, you can use switches that have both licensing models. For example, you can configure a switch stack to use the IP Services Node Locked license on some switches and the IP Services RTU license on other switches. 6.5 You irrevocably authorize PaperCut to deduct from your credit card (or any debit card accepted by PaperCut) any amount due and payable under this Agreement without further reference to you. 3.11 If you have ordered maintenance and support services in the details of the contract, PaperCut will provide the maintenance and support services for 12 months from the effective date in accordance with clause 5 upon acceptance of your order. (Optional) Activates the switch and automatically accepts the End User License Agreement (EULA). This can be useful in scenarios where deployment is automated using installation scripts. 3.6 If you have requested a free trial license for the Software (via the Website or otherwise), PaperCut will make the Software available to you for download from the Website, subject to your acceptance of this Agreement. AKN owns and/or has an interest in or in the Software or other teenSMART materials, except as expressly provided herein. You agree that all copies of the Software contain the same proprietary notices that appear on and in the Software. .
